Oblast platnosti<\/strong><\/p>\n<p>1.1<br \/>\nN\u00e1sleduj\u00edc\u00ed v\u0161eobecn\u00e9 obchodn\u00ed podm\u00ednky plat\u00ed pro smlouvy o n\u00e1jemn\u00edm poskytnut\u00ed pokoj\u016f v penzionu za \u00fa\u010delem ubytov\u00e1n\u00ed a kon\u00e1n\u00ed akc\u00ed, stejn\u011b jako pro ve\u0161ker\u00e9 dal\u0161\u00ed slu\u017eby a dod\u00e1vky penzionu poskytovan\u00e9 hostovi.<\/p>\n<p>1.2<br \/>\nOdchyln\u00e1 ujedn\u00e1n\u00ed jsou platn\u00e1 pouze tehdy, pokud byla mezi hostincem a hostem individu\u00e1ln\u011b dohodnuta.<\/p>\n<p><strong><br \/>\n2. Uzav\u0159en\u00ed smlouvy<\/strong><\/p>\n<p>2.1<br \/>\nSmlouva o p\u0159ijet\u00ed (ubytovac\u00ed smlouva) vznik\u00e1 t\u00edm, \u017ee host pod\u00e1 \u017e\u00e1dost (rezervaci pokoje), kterou hostinec p\u0159ijme. P\u0159ijet\u00ed prob\u00edh\u00e1 potvrzen\u00edm rezervace pokoje. Pokud je rezervace provedena p\u00edsemn\u011b, mezi co\u017e pat\u0159\u00ed i rezervace e-mailem, faxem, prost\u0159ednictv\u00edm elektronick\u00e9ho rezerva\u010dn\u00edho formul\u00e1\u0159e nebo p\u0159es online rezerva\u010dn\u00ed platformu, pova\u017euje se \u017e\u00e1dost za p\u0159ijatou pouze s na\u0161\u00edm p\u00edsemn\u00fdm potvrzen\u00edm (tak\u00e9 e-mailem nebo faxem).  <\/p>\n<p>2.2<br \/>\nPokud rezervaci pokoje provede t\u0159et\u00ed osoba pro hosta, ru\u010d\u00ed hostinci spolu s hostem jako spoludlu\u017en\u00edk za ve\u0161ker\u00e9 z\u00e1vazky z ubytovac\u00ed smlouvy, pokud m\u00e1 hostinec k dispozici odpov\u00eddaj\u00edc\u00ed prohl\u00e1\u0161en\u00ed t\u0159et\u00ed osoby.<\/p>\n<p>2.3<br \/>\nPodn\u00e1jem a dal\u0161\u00ed pron\u00e1jem poskytnut\u00fdch pokoj\u016f, stejn\u011b jako jejich vyu\u017eit\u00ed k jin\u00fdm \u00fa\u010del\u016fm ne\u017e ubytov\u00e1n\u00ed, vy\u017eaduj\u00ed p\u0159edchoz\u00ed p\u00edsemn\u00fd souhlas hostince.<\/p>\n<p><strong><br \/>\n3. Ceny a slu\u017eby<\/strong><\/p>\n<p>3.1<br \/>\nHostinec je povinen dr\u017eet hostem rezervovan\u00e9 pokoje k dispozici podle t\u011bchto v\u0161eobecn\u00fdch obchodn\u00edch podm\u00ednek a poskytnout dohodnut\u00e9 slu\u017eby.<\/p>\n<p>3.2<br \/>\nHost je povinen uhradit ceny hostince platn\u00e9, resp. dohodnut\u00e9 za poskytnut\u00ed pokoje a dal\u0161\u00ed slu\u017eby, kter\u00e9 vyu\u017eil. To plat\u00ed i pro slu\u017eby a v\u00fddaje hostince v\u016f\u010di t\u0159et\u00edm osob\u00e1m, kter\u00e9 byly vyvol\u00e1ny hostem nebo objednatelem. <\/p>\n<p>3.3<br \/>\nDohodnut\u00e9 ceny zahrnuj\u00ed z\u00e1konnou DPH stanovenou pro jednotliv\u00e9 slu\u017eby, platnou v den vy\u00fa\u010dtov\u00e1n\u00ed.<\/p>\n<p>3.4<br \/>\nCeny m\u016f\u017ee hostinec zm\u011bnit, pokud host dodate\u010dn\u011b po\u017eaduje zm\u011bny po\u010dtu rezervovan\u00fdch pokoj\u016f, slu\u017eeb hostince nebo d\u00e9lky pobytu host\u016f a hostinec s t\u00edm souhlas\u00ed.<\/p>\n<p>3.5<br \/>\nU rezervac\u00ed proveden\u00fdch 6 m\u011bs\u00edc\u016f a v\u00edce p\u0159ed po\u017eadovan\u00fdm datem p\u0159\u00edjezdu pros\u00edme o pochopen\u00ed, \u017ee p\u0159\u00edslu\u0161n\u00e9 ceny za jednotliv\u00e9 slu\u017eby jsou nez\u00e1vazn\u00e9 a hostinec je m\u016f\u017ee upravit podle sv\u00fdch pot\u0159eb.<\/p>\n<p>3.6<br \/>\nFaktury hostince jsou splatn\u00e9 ihned po doru\u010den\u00ed nebo p\u0159ed\u00e1n\u00ed, bez sr\u00e1\u017eek. Platebn\u00edmi prost\u0159edky jsou zpravidla hotovost, Girocard nebo kreditn\u00ed karta. Vy\u00fa\u010dtov\u00e1n\u00ed prob\u00edh\u00e1 v eurech, ciz\u00ed m\u011bny hostinec nep\u0159ij\u00edm\u00e1.  <\/p>\n<p>Jin\u00e9 platebn\u00ed prost\u0159edky nebo zp\u016fsoby platby jsou mo\u017en\u00e9 pouze s p\u0159edchoz\u00edm souhlasem hostince.<\/p>\n<p>Prodlen\u00ed nast\u00e1v\u00e1, pokud host nezaplat\u00ed do 7 dn\u016f od splatnosti a doru\u010den\u00ed nebo p\u0159ed\u00e1n\u00ed faktury; v\u016f\u010di hostovi, kter\u00fd je spot\u0159ebitelem, to plat\u00ed jen tehdy, pokud je na tyto d\u016fsledky ve faktu\u0159e zvl\u00e1\u0161\u0165 upozorn\u011bno. P\u0159i prodlen\u00ed s platbou je hostinec opr\u00e1vn\u011bn u spot\u0159ebitel\u016f \u00fa\u010dtovat \u00farok z prodlen\u00ed ve v\u00fd\u0161i 5% nad z\u00e1kladn\u00ed \u00farokovou sazbu. V obchodn\u00edm styku \u010din\u00ed \u00farok z prodlen\u00ed 9% nad z\u00e1kladn\u00ed \u00farokovou sazbu. Hostinci z\u016fst\u00e1v\u00e1 vyhrazeno uplatnit vy\u0161\u0161\u00ed \u0161kodu. Za ka\u017edou upom\u00ednku po vzniku prodlen\u00ed m\u016f\u017ee hostinec \u00fa\u010dtovat poplatek za upom\u00ednku ve v\u00fd\u0161i 2,00EUR.    <\/p>\n<p>3.7<br \/>\nHostinec je opr\u00e1vn\u011bn p\u0159i uzav\u0159en\u00ed smlouvy nebo i pozd\u011bji po\u017eadovat p\u0159im\u011b\u0159enou z\u00e1lohu nebo jistotu. V\u00fd\u0161e z\u00e1lohy a jej\u00ed splatnost mohou b\u00fdt ve smlouv\u011b p\u00edsemn\u011b dohodnuty. Hostinec je d\u00e1le opr\u00e1vn\u011bn kdykoli b\u011bhem pobytu hosta v hotelu vystavit pr\u016fb\u011b\u017enou fakturu na vznikl\u00e9 pohled\u00e1vky a po\u017eadovat okam\u017eitou \u00fahradu.  <\/p>\n<p>3.8<br \/>\nHost m\u016f\u017ee zapo\u010d\u00edst nebo sn\u00ed\u017eit pohled\u00e1vku v\u016f\u010di pohled\u00e1vce hotelu pouze tehdy, pokud je jeho pohled\u00e1vka nesporn\u00e1 nebo pravomocn\u011b zji\u0161t\u011bn\u00e1.<\/p>\n<p><strong>4. Nevyu\u017eit\u00e9 slu\u017eby, storno, odstoupen\u00ed hosta<\/strong><\/p>\n<p>4.1<br \/>\nHostinec poskytuje hostovi pr\u00e1vo kdykoli odstoupit. Plat\u00ed p\u0159itom n\u00e1sleduj\u00edc\u00ed ustanoven\u00ed v z\u00e1vislosti na okam\u017eiku storna nebo<br \/>\nodstoupen\u00ed nebo nevyu\u017eit\u00ed smluvn\u011b dohodnut\u00fdch slu\u017eeb hostem: <\/p>\n<p>\u2013 Pokud i p\u0159es platnou smlouvu nedojde k p\u0159\u00edjezdu, n\u00e1le\u017e\u00ed hostinci n\u00e1hrada v pln\u00e9 v\u00fd\u0161i v\u0161ech smluvn\u011b dohodnut\u00fdch slu\u017eeb.<br \/>\n\u2013 Bezplatn\u00e9 storno \/ bezplatn\u00e9 odstoupen\u00ed od smlouvy je mo\u017en\u00e9 do 8 dn\u016f p\u0159ed dnem p\u0159\u00edjezdu.<br \/>\n\u2013 Pokud dojde ke stornu \/ odstoupen\u00ed od smlouvy v den p\u0159\u00edjezdu nebo do 7 dn\u016f p\u0159ed dnem p\u0159\u00edjezdu, n\u00e1le\u017e\u00ed hostinci n\u00e1hrada v pln\u00e9 v\u00fd\u0161i smluvn\u011b dohodnut\u00e9ho ubytov\u00e1n\u00ed.<\/p>\n<p>4.2<br \/>\nN\u00e1rok na n\u00e1hradu zanik\u00e1, pokud hostinec poskytl hostovi ve smlouv\u011b opci odstoupit od smlouvy v ur\u010den\u00e9 lh\u016ft\u011b bez dal\u0161\u00edch pr\u00e1vn\u00edch n\u00e1sledk\u016f; v takov\u00e9m p\u0159\u00edpad\u011b hostinec nem\u00e1 n\u00e1rok na n\u00e1hradu. Pro v\u010dasnost prohl\u00e1\u0161en\u00ed o odstoupen\u00ed je rozhoduj\u00edc\u00ed jeho doru\u010den\u00ed hotelu. Host mus\u00ed odstoupen\u00ed ozn\u00e1mit v textov\u00e9 podob\u011b.  <\/p>\n<p><strong>5. Odstoupen\u00ed hostince<\/strong><\/p>\n<p>5.1<br \/>\nPokud bylo hostovi v ubytovac\u00ed smlouv\u011b poskytnuto bezplatn\u00e9 pr\u00e1vo na odstoupen\u00ed podle bodu 4.2, je hostinec rovn\u011b\u017e opr\u00e1vn\u011bn ve sjednan\u00e9 lh\u016ft\u011b od smlouvy odstoupit, pokud existuj\u00ed popt\u00e1vky jin\u00fdch host\u016f po rezervovan\u00fdch pokoj\u00edch.<\/p>\n<p>5.2<br \/>\nPokud nen\u00ed ve lh\u016ft\u011b stanoven\u00e9 k tomu poskytnuta z\u00e1loha nebo jistota dohodnut\u00e1 podle bodu 3.7, je hostinec rovn\u011b\u017e opr\u00e1vn\u011bn od smlouvy odstoupit.<\/p>\n<p>5.3<br \/>\nPr\u00e1vo odstoupit od smlouvy z d\u016fle\u017eit\u00e9ho d\u016fvodu t\u00edm nen\u00ed dot\u010deno. Existuje zej\u00e9m\u00e9na v p\u0159\u00edpad\u011b, \u017ee: <\/p>\n<p>\u2013 vy\u0161\u0161\u00ed moc nebo jin\u00e9 okolnosti, za kter\u00e9 hostinec neodpov\u00edd\u00e1, znemo\u017en\u00ed spln\u011bn\u00ed smlouvy;<br \/>\n\u2013 pokoje jsou rezervov\u00e1ny za klamn\u00fdch nebo nepravdiv\u00fdch \u00fadaj\u016f o podstatn\u00fdch skute\u010dnostech, nap\u0159. o osob\u011b hosta nebo \u00fa\u010delu;<br \/>\n\u2013 hostinec m\u00e1 opr\u00e1vn\u011bn\u00fd d\u016fvod se domn\u00edvat, \u017ee vyu\u017eit\u00ed slu\u017eby m\u016f\u017ee ohrozit bezprobl\u00e9mov\u00fd provoz, bezpe\u010dnost nebo ve\u0159ejnou pov\u011bst hostince, ani\u017e by to bylo p\u0159i\u010ditateln\u00e9 sf\u00e9\u0159e vlivu \u010di organizace hostince;<br \/>\n\u2013 dojde k neopr\u00e1vn\u011bn\u00e9mu podn\u00e1jmu nebo dal\u0161\u00edmu pron\u00e1jmu podle bodu 2.3;<br \/>\n\u2013 dojde k pou\u017eit\u00ed pronajat\u00e9ho pokoje v rozporu se smlouvou, nap\u0159. poru\u0161en\u00ed z\u00e1kazu kou\u0159en\u00ed, vandalismus, zp\u016fsoben\u00ed zne\u010di\u0161t\u011bn\u00ed nebo z\u00e1ne\u010di\u0161t\u011bn\u00ed p\u0159esahuj\u00edc\u00edch b\u011b\u017enou m\u00edru obvykl\u00e9ho u\u017e\u00edv\u00e1n\u00ed pokoje v penzionu;<br \/>\n\u2013 nastane p\u0159\u00edpad podle bodu 6.3;<br \/>\n\u2013 hostinec zjist\u00ed okolnosti, \u017ee se majetkov\u00e9 pom\u011bry hosta po uzav\u0159en\u00ed smlouvy podstatn\u011b zhor\u0161ily, zejm\u00e9na pokud host nevyrovn\u00e1 splatn\u00e9 pohled\u00e1vky hostince nebo neposkytne dostate\u010dnou jistotu a proto se jev\u00ed ohro\u017een\u00e9 platebn\u00ed n\u00e1roky hostince;<br \/>\n\u2013 host podal n\u00e1vrh na zah\u00e1jen\u00ed insolven\u010dn\u00edho \u0159\u00edzen\u00ed, poskytl majetkov\u00e9 prohl\u00e1\u0161en\u00ed podle \u00a7 807 ob\u010dansk\u00e9ho soudn\u00edho \u0159\u00e1du, zah\u00e1jil mimosoudn\u00ed \u0159\u00edzen\u00ed slou\u017e\u00edc\u00ed k \u00faprav\u011b dluh\u016f nebo zastavil platby;<br \/>\n\u2013 insolven\u010dn\u00ed \u0159\u00edzen\u00ed na majetek hosta je zah\u00e1jeno nebo je jeho zah\u00e1jen\u00ed odm\u00edtnuto pro nedostatek majetku nebo z jin\u00fdch d\u016fvod\u016f. <\/p>\n<p>5.4<br \/>\nHostinec bude hosta o uplatn\u011bn\u00ed pr\u00e1va na odstoupen\u00ed neprodlen\u011b informovat v textov\u00e9 podob\u011b.<\/p>\n<p>5.5<br \/>\nV uveden\u00fdch p\u0159\u00edpadech odstoupen\u00ed nevznik\u00e1 hostovi n\u00e1rok na n\u00e1hradu \u0161kody.<\/p>\n<p><strong>6. P\u0159\u00edjezd a odjezd \/ mo\u017enosti parkov\u00e1n\u00ed<\/strong><\/p>\n<p>6.1<br \/>\nHost zpravidla nez\u00edsk\u00e1v\u00e1 n\u00e1rok na poskytnut\u00ed konkr\u00e9tn\u00edch pokoj\u016f, leda\u017ee hostinec poskytnut\u00ed konkr\u00e9tn\u00edch pokoj\u016f p\u00edsemn\u011b potvrdil.<\/p>\n<p>6.2<br \/>\nRezervovan\u00e9 pokoje jsou hostovi k dispozici od cca 14:00 v dohodnut\u00fd den p\u0159\u00edjezdu. Host nem\u00e1 n\u00e1rok na d\u0159\u00edv\u011bj\u0161\u00ed zp\u0159\u00edstupn\u011bn\u00ed. <\/p>\n<p>6.3<br \/>\nRezervovan\u00e9 pokoje mus\u00ed host vyu\u017e\u00edt nejpozd\u011bji do 18:00 v dohodnut\u00fd den p\u0159\u00edjezdu. Pokud nebyl v\u00fdslovn\u011b dohodnut pozd\u011bj\u0161\u00ed \u010das p\u0159\u00edjezdu, m\u00e1 hostinec pr\u00e1vo po 18:00 rezervovan\u00e9 pokoje p\u0159id\u011blit jinak, ani\u017e by z toho host mohl vyvozovat n\u00e1roky na n\u00e1hradu. Hostinci v tomto ohledu n\u00e1le\u017e\u00ed pr\u00e1vo odstoupit od smlouvy.  <\/p>\n<p>6.4<br \/>\nV dohodnut\u00fd den odjezdu je t\u0159eba pokoje uvolnit a p\u0159edat hostinci nejpozd\u011bji do 11:00. Pot\u00e9 m\u016f\u017ee hostinec krom\u011b vznikl\u00e9 \u0161kody \u00fa\u010dtovat za dal\u0161\u00ed u\u017e\u00edv\u00e1n\u00ed pokoje do 14:00 nebo d\u00e9le denn\u00ed cenu pokoje v pln\u00e9 v\u00fd\u0161i. Host m\u00e1 pr\u00e1vo prok\u00e1zat hotelu, \u017ee mu nevznikla \u017e\u00e1dn\u00e1 nebo podstatn\u011b ni\u017e\u0161\u00ed \u0161koda.  <\/p>\n<p>6.5<br \/>\nHost m\u00e1 mo\u017enost bezplatn\u011b zaparkovat sv\u00e9 vozidlo na parkovi\u0161ti \u201eSch\u00fctzenplan\u201c, kter\u00e9 p\u0159\u00edmo navazuje na n\u00e1\u0161 pozemek.<br \/>\nVoln\u00e9 plochy v r\u00e1mci na\u0161eho pozemku jsou vyhrazeny v\u00fdhradn\u011b person\u00e1lu a denn\u00edm host\u016fm, kte\u0159\u00ed nav\u0161t\u011bvuj\u00ed na\u0161i restauraci nebo akce v na\u0161em s\u00e1le.<\/p>\n<p><strong>7. Odpov\u011bdnost hostince<\/strong><\/p>\n<p>7.1<br \/>\nHostinec odpov\u00edd\u00e1 v p\u0159\u00edpadech \u00famyslu nebo hrub\u00e9 nedbalosti podle z\u00e1konn\u00fdch ustanoven\u00ed. Za lehkou nedbalost odpov\u00edd\u00e1 hostinec v\u00fdhradn\u011b za \u00fajmu na \u017eivot\u011b, t\u011ble nebo zdrav\u00ed nebo za poru\u0161en\u00ed podstatn\u00fdch smluvn\u00edch povinnost\u00ed. Za v\u011bci vnesen\u00e9 hostem odpov\u00edd\u00e1 hostinec podle platn\u00fdch z\u00e1konn\u00fdch p\u0159edpis\u016f. Za cennosti, hotovost nebo kreditn\u00ed \u010di podobn\u00e9 karty hostinec nep\u0159eb\u00edr\u00e1 odpov\u011bdnost; vnesen\u00ed uveden\u00fdch v\u011bc\u00ed prob\u00edh\u00e1 v\u00fdhradn\u011b na vlastn\u00ed riziko a nebezpe\u010d\u00ed hosta. N\u00e1rok na n\u00e1hradu \u0161kody za lehce nedbal\u00e9 poru\u0161en\u00ed podstatn\u00fdch smluvn\u00edch povinnost\u00ed je omezen na typickou, p\u0159edv\u00eddatelnou \u0161kodu, pokud se neodpov\u00edd\u00e1 za \u00fajmu na \u017eivot\u011b, t\u011ble nebo zdrav\u00ed. Za zavin\u011bn\u00ed pomocn\u00fdch osob a z\u00e1stupc\u016f odpov\u00edd\u00e1 hostinec ve stejn\u00e9m rozsahu.     <\/p>\n<p>7.2<br \/>\nUstanoven\u00ed p\u0159edchoz\u00edho odstavce (7.1) se vztahuje na n\u00e1hradu \u0161kody vedle pln\u011bn\u00ed, n\u00e1hradu \u0161kody nam\u00edsto pln\u011bn\u00ed a n\u00e1rok na n\u00e1hradu marn\u011b vynalo\u017een\u00fdch n\u00e1klad\u016f, bez ohledu na pr\u00e1vn\u00ed d\u016fvod, v\u010detn\u011b odpov\u011bdnosti za vady, prodlen\u00ed nebo nemo\u017enost pln\u011bn\u00ed.<\/p>\n<p>7.3<br \/>\nHost nem\u00e1 pr\u00e1vo vyu\u017e\u00edvat parkovac\u00ed mo\u017enosti nach\u00e1zej\u00edc\u00ed se na pozemku hostince. Ty jsou vyhrazeny v\u00fdhradn\u011b person\u00e1lu a host\u016fm na\u0161eho s\u00e1lov\u00e9ho a restaura\u010dn\u00edho provozu. Host\u00e9 penzionu maj\u00ed mo\u017enost parkovat na parkovi\u0161ti \u201eSch\u00fctzenplan\u201c, kter\u00e9 se nach\u00e1z\u00ed bezprost\u0159edn\u011b za pozemkem hostince. Pokud host p\u0159esto parkuje na ploch\u00e1ch n\u00e1le\u017eej\u00edc\u00edch k pozemku hostince, \u010din\u00ed tak na vlastn\u00ed riziko a nebezpe\u010d\u00ed.   <\/p>\n<p>7.4<br \/>\nBud\u00edc\u00ed slu\u017eba se v hostinci neposkytuje.<\/p>\n<p>7.5<br \/>\nZpr\u00e1vy, po\u0161ta a z\u00e1silky pro hosty jsou vy\u0159izov\u00e1ny s p\u00e9\u010d\u00ed. Hostinec zaji\u0161\u0165uje doru\u010den\u00ed, \u00faschovu a \u2013 na p\u0159\u00e1n\u00ed \u2013 za poplatek i p\u0159eposl\u00e1n\u00ed, a na vy\u017e\u00e1d\u00e1n\u00ed tak\u00e9 vy\u0159izov\u00e1n\u00ed n\u00e1lez\u016f. N\u00e1roky na n\u00e1hradu \u0161kody, s v\u00fdjimkou hrub\u00e9 nedbalosti nebo \u00famyslu, jsou<br \/>\nvylou\u010deny. Hostinec je opr\u00e1vn\u011bn po nejpozd\u011bji jednom\u011bs\u00ed\u010dn\u00ed lh\u016ft\u011b \u00faschovy, p\u0159i \u00fa\u010dtov\u00e1n\u00ed p\u0159im\u011b\u0159en\u00e9ho poplatku, p\u0159edat v\u00fd\u0161e uveden\u00e9 v\u011bci m\u00edstn\u00edmu \u00fa\u0159adu ztr\u00e1t a n\u00e1lez\u016f.   <\/p>\n<p>7.6<br \/>\nProml\u010den\u00ed n\u00e1rok\u016f hosta se \u0159\u00edd\u00ed z\u00e1konn\u00fdmi ustanoven\u00edmi.<\/p>\n<p><strong>8. Odpov\u011bdnost hosta  <\/strong><\/p>\n<p>8.1<br \/>\nPokud host ztrat\u00ed svou kl\u00ed\u010dovou kartu nebo ji p\u0159ed\u00e1 t\u0159et\u00ed osob\u011b, odpov\u00edd\u00e1 host s\u00e1m za jej\u00ed ztr\u00e1tu a\/nebo mo\u017en\u00e9 zneu\u017eit\u00ed kl\u00ed\u010dov\u00e9 karty t\u0159et\u00edmi osobami. To se t\u00fdk\u00e1 zejm\u00e9na kr\u00e1de\u017e\u00ed a po\u0161kozen\u00ed majetku, kter\u00e9 se t\u00fdkaj\u00ed jak vlastnictv\u00ed\/dr\u017eby samotn\u00e9ho hosta, jin\u00fdch host\u016f, hostince nebo zam\u011bstnanc\u016f hostince. <\/p>\n<p>8.2<br \/>\nZa \u0161kody v pokoji \/ na budov\u011b, kter\u00e9 host zp\u016fsob\u00ed \u00famysln\u011b nebo ne\u00famysln\u011b, odpov\u00edd\u00e1 host (p\u0159\u00edpadn\u011b jeho poji\u0161t\u011bn\u00ed odpov\u011bdnosti) v pln\u00e9m rozsahu. Tot\u00e9\u017e plat\u00ed pro zv\u00ed\u0159ata, kter\u00e1 si host p\u0159iveze. <\/p>\n<p>8.3<br \/>\nZa \u0161kody na vybaven\u00ed v pokoji \/ v budov\u011b, kter\u00e9 host zp\u016fsob\u00ed \u00famysln\u011b nebo ne\u00famysln\u011b, odpov\u00edd\u00e1 host (p\u0159\u00edpadn\u011b jeho poji\u0161t\u011bn\u00ed odpov\u011bdnosti) v pln\u00e9m rozsahu. Tot\u00e9\u017e plat\u00ed pro zv\u00ed\u0159ata, kter\u00e1 si host p\u0159iveze. <\/p>\n<p>8.4<br \/>\nPokud host nebo j\u00edm p\u0159ivezen\u00e9 zv\u00ed\u0159e zp\u016fsob\u00ed zne\u010di\u0161t\u011bn\u00ed a z\u00e1ne\u010di\u0161t\u011bn\u00ed pokoje, budovy nebo vybaven\u00ed, kter\u00e9 p\u0159esahuje b\u011b\u017enou m\u00edru obvykl\u00e9ho u\u017e\u00edv\u00e1n\u00ed pokoje v penzionu, nech\u00e1 provozovatel hostince tato zne\u010di\u0161t\u011bn\u00ed odstranit na n\u00e1klady hosta.<\/p>\n<p>8.5.<br \/>\nZa\u0159\u00edzen\u00ed slou\u017e\u00edc\u00ed bezpe\u010dnosti host\u016f a hostince (elektronick\u00e9 z\u00e1mky, mechanick\u00e9 z\u00e1mky, hl\u00e1si\u010de po\u017e\u00e1ru, sir\u00e9ny, hasic\u00ed p\u0159\u00edstroje, s\u00ed\u0165ov\u00e1 za\u0159\u00edzen\u00ed aj.) nesm\u00ed host nijak omezovat v jejich funkci ani je po\u0161kozovat, ni\u010dit, demontovat, m\u011bnit nebo zneu\u017e\u00edvat. Pokud k takov\u00e9mu jedn\u00e1n\u00ed p\u0159esto dojde, odpov\u00edd\u00e1 host za ve\u0161ker\u00e9 z toho vypl\u00fdvaj\u00edc\u00ed v\u011bcn\u00e9 a\/nebo osobn\u00ed \u0161kody. <\/p>\n<p>8.6<br \/>\nHost je informov\u00e1n, \u017ee pronaj\u00edm\u00e1me v\u00fdhradn\u011b neku\u0159\u00e1ck\u00e9 pokoje. Pokud host p\u0159esto v pokoji kou\u0159\u00ed (to zahrnuje i kou\u0159en\u00ed u okna), jedn\u00e1 se o chov\u00e1n\u00ed hosta v rozporu se smlouvou. Hostinec m\u00e1 pr\u00e1vo ubytovac\u00ed smlouvu okam\u017eit\u011b vypov\u011bd\u011bt. Za obnoven\u00ed pokoje do smluvn\u00edho stavu neku\u0159\u00e1ck\u00e9ho pokoje hostinec vy\u00fa\u010dtuje vznikl\u00e9 n\u00e1klady.   <\/p>\n<p><strong>9. Z\u00e1v\u011bre\u010dn\u00e1 ustanoven\u00ed \u2013 salv\u00e1torsk\u00e1 klauzule<\/strong><\/p>\n<p>9.1<br \/>\nPlat\u00ed pr\u00e1vo Spolkov\u00e9 republiky N\u011bmecko.<\/p>\n<p>9.2<br \/>\nPokud by jednotliv\u00e1 ustanoven\u00ed t\u00e9to smlouvy byla neplatn\u00e1 nebo neprovediteln\u00e1, nebo se po uzav\u0159en\u00ed smlouvy stala neplatn\u00e1 nebo neprovediteln\u00e1, nen\u00ed t\u00edm dot\u010dena platnost smlouvy v ostatn\u00edm.
